These Terms and Conditions govern access to and use of chatassist24.com<\/strong>, as well as the purchase, licensing, support, updates, renewals and use of the ChatAssist24<\/strong> plugin.<\/p>\n

Product<\/h2>\n

ChatAssist24 is a WordPress plugin designed to create a conversational assistant for websites, online stores and service businesses, including features such as automated replies, tours, lead capture, campaigns, surveys, support, WooCommerce, recommender tools, quote simulators and related features.<\/p>\n

Free plan and paid licences<\/h2>\n

ChatAssist24 may offer a free plan and paid plans. Features, installation limits, support, updates, licence duration and included capabilities depend on the selected plan.<\/p>\n

Paid licences are offered on an annual basis.<\/p>\n

Purchase process<\/h2>\n

Paid licences are purchased through Freemius. When starting the purchase process, the user will be redirected to the relevant checkout or portal, where the price, applicable taxes, currency, payment method, billing details, renewal terms and transaction confirmation will be displayed.<\/p>\n

The paid contract will be completed when the checkout confirms the transaction and the corresponding licence is issued or activated.<\/p>\n

Freemius, payments, invoicing and taxes<\/h2>\n

ChatAssist24 licence payments are processed through Freemius. For transactions processed through its checkout, Freemius may act as reseller, Merchant of Record, payment processor, invoicing entity for the buyer and manager of applicable indirect taxes.<\/p>\n

This means that Freemius may calculate, collect and remit VAT, sales tax or other taxes depending on the buyer\u2019s country, billing details, currency, valid VAT ID or other applicable circumstances.<\/p>\n

Rub\u00e9n Teruel C\u00f3rcoles does not directly charge the end customer when the transaction is fully processed through Freemius checkout. In that case, the buyer\u2019s invoice will be issued by the entity identified in the checkout, invoice or customer portal.<\/p>\n

Final price<\/h2>\n

Prices displayed on the website are for commercial and informational purposes. The final price, taxes, currency and exact payment terms will be those displayed in the Freemius checkout at the time of purchase.<\/p>\n

Licence grant<\/h2>\n

Purchasing a ChatAssist24 licence grants the customer a limited, non-exclusive, non-sublicensable, non-transferable and revocable licence to install and use the plugin according to the subscribed plan.<\/p>\n

The licence does not constitute a sale of the software or a transfer of intellectual property rights. The customer may not resell, sublicense, distribute, modify, decompile, reverse engineer, circumvent licence limits or exploit the plugin beyond the scope permitted by law and by the purchased plan.<\/p>\n

Installation limits<\/h2>\n

The number of permitted installations depends on the selected plan. If the limit is exceeded, the customer may need to upgrade the plan or purchase an additional licence.<\/p>\n

Support and updates<\/h2>\n

While the licence is active, the customer is entitled to support and updates included in the subscribed plan.<\/p>\n

Support is provided by email or ticket. Support covers issues related to the standard operation of the plugin, but does not include, unless expressly agreed, custom development, complex customisations, general WordPress maintenance, conflicts caused by third parties, hosting configuration, web design, strategic consultancy or custom integration with external tools.<\/p>\n

Automatic renewal<\/h2>\n

Paid licences are annual and renew automatically unless cancelled before the renewal date.<\/p>\n

The customer may cancel future renewals through the customer portal provided by Freemius or by contacting support. Cancellation prevents future charges but does not necessarily imply a refund for periods already paid, unless required under the Refund Policy or applicable law.<\/p>\n

Uninstalling, disabling or not using the plugin does not by itself cancel the subscription.<\/p>\n

Free plan<\/h2>\n

The free plan may have limited features, may not include priority support and may be changed, suspended or withdrawn. Use of the free plan does not automatically grant entitlement to personalised support, premium updates or paid features.<\/p>\n

Right of withdrawal and digital content<\/h2>\n

ChatAssist24 is a digital product. When the user purchases a licence, access to the software, download, licence or activation may begin immediately after purchase.<\/p>\n

If the buyer is a consumer, they may have a legal 14-day withdrawal right unless they have expressly accepted the immediate start of the digital supply and, where applicable, the loss or limitation of the withdrawal right under applicable law.<\/p>\n

This does not limit the consumer\u2019s legal rights in case of lack of conformity of the digital content or service.<\/p>\n

Refunds<\/h2>\n

ChatAssist24\u2019s commercial refund policy is 14 days<\/strong> from the initial purchase or renewal, according to the Refund Policy published on this website.<\/p>\n

Refunds will be processed through Freemius or the relevant payment system where the transaction was processed by that platform.<\/p>\n

Licence suspension or cancellation<\/h2>\n

We may suspend or cancel a licence in case of fraud, non-payment, chargeback, system abuse, unauthorised use, breach of these terms, unlawful distribution of the plugin or attempts to bypass technical or commercial limits.<\/p>\n

Compatibility<\/h2>\n

ChatAssist24 is designed for WordPress. Certain features may require WooCommerce, a specific WordPress version, additional plugins, technical configuration or third-party services.<\/p>\n

Compatibility with every installation, theme, plugin, server, configuration or third-party customisation is not guaranteed.<\/p>\n

Limitation of liability<\/h2>\n

To the fullest extent permitted by law, ChatAssist24 is provided without guarantee that it will be error-free or compatible with all technical environments.<\/p>\n

Except in cases of wilful misconduct, gross negligence or liability that cannot legally be excluded, total liability for direct damages shall be limited to the amount actually paid by the customer for the affected licence during the 12 months preceding the event giving rise to the claim.<\/p>\n

We shall not be liable for loss of profit, loss of data, loss of business, business interruption, indirect damages or problems caused by third parties, unless otherwise required by law.<\/p>\n

Data protection<\/h2>\n

Personal data processing is governed by the Privacy Policy. Payments, invoicing, licences, subscriptions and customer portal managed by Freemius are also governed by that platform\u2019s terms and policies.<\/p>\n

Applicable law and jurisdiction<\/h2>\n

These Terms are governed by Spanish law, without prejudice to any mandatory rights consumers may have under the law of their country of residence.<\/p>\n

Any dispute shall be submitted to the competent Spanish courts, unless applicable law provides for another mandatory venue.<\/p>\n
